Standard conditions of sale
This contract shall be subject to these terms and conditions of sale. Just Care Group Ltd reserves the right to amend these conditions at any time. These terms and conditions shall take precedence over any other terms and conditions, unless otherwise agreed in writing.

Definitions

In these terms and conditions ‘the Seller’ means Just Care Group Ltd and the company’s website https://justcarepodiatry.co.uk/ and ‘the Buyer’ means the purchaser of goods from the Seller under these terms and conditions.

Trade Only

All product and product information available through Just Care Group Ltd’s catalogue and website are intended solely for qualified healthcare professionals, and are offered for sale strictly on a business to business basis. Just Care Group Ltd and any associated companies exclude any liability for damages or loss by unqualified users of the products. Just Care Group Ltd reserves the right to refuse to accept orders if it believes that a Buyer is not a trade customer.

Prices

All prices on the website and catalogue are in GBP and shown exclusive of VAT, which will be charged at the rate relevant at the date of invoice, where applicable. The prices on the website and catalogue are correct at the time of display / printing but the Seller reserves the right to change them at any time without prior notice.

Payment

Payment is due to the Seller in full prior to despatch of goods. Payment must be made in GBP only and by one of the following methods: bank transfer, Visa, MasterCard, Delta, Maestro, Visa Electron or PayPal. Fraudulent use of Credit/Debit cards will be reported to the relevant authorities.

30-day credit accounts are available upon request subject to fulfilment of certain criteria. Any invoice queries must be notified within 30 days of invoice date.

Delivery

For orders less than £70.00 excluding VAT there will be a standard delivery charge of £5.95 excluding VAT to UK mainland areas unless you are in the exception postcode area, please see b):

Free delivery on all orders over £70.00 excluding VAT to UK mainland except for:

a) some large and heavy furniture and equipment;

b) the following exception postcode areas:

Delivery charges for the exception postcodes above: 

• For orders less than £100 excluding VAT: £12.50 plus VAT

• For orders over £100 excluding VAT: Free Delivery

The Buyer shall ensure presence at the delivery address to sign for the delivery. The Buyer shall always check the number of parcels received upon delivery and sign the Consignment as ‘Unchecked’ so as to confirm that the items have not been inspected in respect of any damages and /or missing items. If the parcel appears damaged, the Buyer shall sign the Consignment as ‘Damaged’ and inform the Seller within three (3) days of receipt of goods.

Next Day Delivery

Orders must be received before 3:00pm Monday to Friday for next working day delivery. Next-day delivery only applies to items that are in stock. The Seller can accept no responsibility for transport delays causing late delivery of items. Next-day delivery is available for mainland UK only. Saturday deliveries can be arranged by request and attract an additional charge.

While we will attempt to get your parcel to you the next working day, please note that due to the current COVID19 situation we can not guarantee this service.

Shortages, Damages and Claims

The Seller shall not be liable to the Buyer for any shortages in quantity delivered, damage or loss, or any defects in the products unless the Buyer notifies the Seller in writing within three (3) days of receipt of the goods. The notification must include the name and address of the Buyer; the quantity and description of the good(s); photographic evidence; and the invoice number and date of relevant invoice. Where liability is accepted, the only obligation of the Seller shall be, at its option, to make good any shortage or non-delivery and / or replace any good found to be damaged or defective and / or refund the cost of any such goods by a credit note.

If goods have been ordered in error the Buyer must request an authorisation form from the Seller to return the goods. No goods will be accepted as a return without a pre-authorisation number. Goods must be returned within 7 days of receipt, unused and in their original packaging. The Seller accepts no responsibility for lost parcels without a confirmation of the despatch of the parcel to the Seller.

If goods have been ordered in error, the Buyer must pay for the return. If goods are being returned because they are faulty or damaged, the Seller will pay for the return.

Refunds on large, heavy, or non-stocked items will be subject to a minimum 10% net invoice handling and inspection charge. Refunds on electrical items have a 25% restocking fee.

Warranty

All items are guaranteed according to manufacturer’s warranty Please contact the Seller’s customer services team to find out specific warranty details. The Seller offers no further or additional warranty than that provided by the manufacturer.

Where goods appear faulty during the warranty period, the Seller shall, at its option, repair or replace the faulty good, or refund the cost of the defective good less any handling charges, provided that the Seller is given a reasonable opportunity to inspect the good, and the Buyer, if asked to do so, returns the good. If an item is to be inspected, a returns number will be issued and must be visible on the outer packaging of the returned item together with any decontamination details. Faulty goods that are returned may take up to 28 days to be tested and repaired or replaced.

The Seller shall not be liable for the item’s failure to comply with the manufacturer’s warranty as set out above, if (a) the Buyer makes any further use of the item after giving notice; (b) the defect arose because the Buyer failed to follow the Seller’s or the manufacturer’s instructions (oral or written) or good practice as to the storage, installation, use and maintenance of the item; (c) the item was altered or repaired without the written consent of the Seller; or (d) the defect arose as a result of fair wear and tear, wilful damage, negligence or abnormal use, storage or working conditions.

Save as expressly provided in these conditions, all conditions, warranties, representations and other terms expressed or implied by statute, common law or otherwise in relation to the products are hereby excluded to the fullest extent permitted by law. Nothing in these conditions shall limit or exclude the liability of either party for (a) death or personal injury caused by negligence (b) fraud or fraudulent misrepresentation or (c) breach of terms implied by s12 of the Sale of Goods Act 1979. .

No liability will be accepted in relation to consequential damage, injury or loss of revenue arising from defective items, whether such a claim arises in contract or otherwise.

Cancellations and Variations

Following acceptance, orders may only be cancelled if the item is currently out of stock, or its manufacture has not yet begun. Requests for cancellation must be made in writing. Variations can only be accepted if the goods have not been manufactured or despatched. Any variations must be notified in writing.

Overseas Orders

The Seller welcomes overseas orders. The Buyer shall pay for cost of carriage which will vary depending on destination and weight of parcel. When ordering goods for delivery outside the United Kingdom the Buyer may be subject to import duties, taxes and clearance charges, which will be the responsibility of the Buyer. The Seller shall only accept payment for any overseas orders by bankers’ drafts or CHAPS transfers to be made at the time of order.

Certain products are restricted for sale in the UK and cannot be shipped to other Countries outside of these restrictions. Please contact Just Care Group Ltd for further information.

Customer Accounts

If you use our website, you will be responsible for maintaining the confidentiality of your account including your account and password and accept all responsibility for all activities that occur under your account and password. If you believe that your password has become known to anyone else, you must inform us immediately. The Seller reserves the right to terminate accounts or cancel orders at its discretion. If an order is cancelled before being dispatched the buyer will not be charged.

Online Orders

When you place an order with https://justcarepodiatry.co.uk/ we will send you an email to confirm receipt of your order and containing details of your order. Your order represents an offer to purchase a product which is accepted by us when we dispatch that product to you. Any products that are on the same order but are not dispatched do not form part of that contract.

All content on the website is the property of Just Care Group Ltd or our suppliers. All software used on this website is the property of Just Care Group Ltd or our software suppliers. You may not extract or reutilise any of the contents of the website without the written permission from Just Care Group Ltd.

Just Care Group Ltd grants you a limited license to access and make personal use of this website, but not to download (other than page caching) or modify it, or any portion of it except with the written permission from Just Care Group Ltd. This license does not include any resale or commercial use of this website or its contents, any downloading or copying of account information for the benefit of another seller.

We welcome your feedback and thank you for sharing your views and ratings with us and our other customers, however all reviews are monitored and must adhere to the following guidelines to be posted onto the review section of a product:

a) you can review any product that is for sale on https://justcarepodiatry.co.uk/;

b) reviews have to be relevant to the specific product quality, not the buying experience or delivery of the product;

c) please rate the product from 1 to 5 stars;

d) reviews will not be posted if they contain any of the following:

i. contains any derogatory comments to any other reviewer;

ii. contains any content that might be considered offensive or obscene including any use of expletives;

iii. false or defamatory statements or impersonating others;

Reservation of Title

The legal title of goods will remain with the Seller until all dues and payments for goods have been satisfactorily received and cleared, at which point title will transfer to the Buyer. The Buyer may, in the ordinary course of business, resell the products on normal trade terms, notwithstanding that at the time of such resale the products remain the property of the Seller, provided that the Buyer shall (a) account to Just Care Group Ltd as bailee for the sale proceeds to the limit of the total owed to Just Care Group Ltd; and (b) hold the sale proceeds in a separate account as trustee for Just Care Group Ltd until all sums due are paid.

General

All goods are subject to stock availability.

The Seller takes special care to show correct sizes and specifications and such descriptions, whilst given as a guide in good faith, are subject to alteration by the Seller without notice. All colours shown are as near as can be displayed on a colour monitor.

Force Majeure

Deliveries against the contract may be suspended or cancelled pending any contingencies beyond our control and the Seller shall not be liable for any loss or damage occasioned to the Buyer thereby.

Jurisdiction

These terms and conditions and all contracts entered into under them are governed by and are to be construed in accordance with the laws of England and Wales.
